Should Waiguru make good her threat, it will be the second time she is seeking legal redress for the same matter. She had taken the ODM leader Raila Odinga to court for dragging her good name into the NYS graft under a certificate of urgency on September 2015. However, in 2018, it was confirmed Josephine Kabura who said she worked for Waiguru and introduced herself as her associate during the scandal, had allegedly lied in an affidavit she filed. In the affidavit, Kabura told the court the ex-CS tried to cover up the looting by diverting attention from investigating bodies and implicating junior officers in her ministry. "I would carry the money in one bag at a time to the site. A bag would fit between KSh 10 million and KSh 20 million. The suppliers at the quarry were working day and night and I had to have ready cash with me,” she told Public Accounts Committee in 2015
